1. Agreement to These Terms

These Terms of Service ("Terms") govern your use of the NCLEX Achiever website at nclexachiever.com, our Android app, and all related features and content (together, the "Service"). "NCLEX Achiever", "we", "us" and "our" refer to the operator of the Service. "You" means the person using the Service.

By creating an account, purchasing a subscription or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. About the Service

NCLEX Achiever is an online study platform for nursing candidates preparing for the NCLEX-RN, NCLEX-PN and related licensing exams. It includes practice questions with rationales, standard and adaptive (CAT) practice exams, study topics, case studies, flashcards, performance tracking and Nurzo, our AI coaching feature.

NCLEX®, NCLEX-RN® and NCLEX-PN® are registered trademarks of the National Council of State Boards of Nursing, Inc. (NCSBN). NCLEX Achiever is an independent study resource and is not affiliated with, sponsored by or endorsed by NCSBN or any nursing regulatory body. Our practice exams are simulations and are not the official NCLEX.

3. Eligibility and Accounts

• You must be at least 18 years old, or the age of legal majority where you live, to create an account or buy a subscription.
• You agree to give accurate information when you register and to keep your email address up to date, because we use it to verify your account and contact you about billing.
• Your account is for you alone. You may not share your login, sell or transfer your account, or let other people use your subscription.
• You are responsible for keeping your password secure and for activity on your account. Tell us right away at support@nclexachiever.com if you think someone else has accessed it.

4. Free Starter Plan

The Starter plan is free and does not require a payment method. It gives limited access to the Service so you can try it before subscribing. The features included in Starter are listed on our pricing pages and may change over time.

5. Premium Subscriptions and Billing

• Payment through PayPal. Premium plans are currently sold only on our website and paid through PayPal. We do not receive or store your card or bank details; PayPal processes your payment under its own terms and privacy policy. Premium is not sold through Google Play or App Store billing.
• Plans and prices. The available plans, their billing periods and prices are shown on our pricing page at the time you subscribe. Prices are in US dollars. If PayPal converts the charge into another currency, any conversion rate or fee is set by PayPal or your bank, not by us.
• Automatic renewal. Every Premium plan is a recurring subscription. By subscribing, you authorize PayPal to charge the plan price at the start of each billing period (monthly, every 90 days, every 6 months or yearly, depending on the plan you chose) until you cancel.
• Activation. Premium is activated on your NCLEX Achiever account after PayPal confirms your subscription. If you are charged but Premium does not appear on your account, contact us and we will fix it or refund you (see Refund Policy).
• Price changes. We may change our prices. A price change will never affect a billing period you have already paid for, and we will notify you before any new price applies to an existing subscription.
• Feature limits. Some features, such as the number of Nurzo plans or messages per day, have usage limits that depend on your plan. These limits are shown on our pricing page.

6. Cancellation

You can cancel your subscription at any time. To cancel:

1. Log in to your PayPal account.
2. Go to Settings, then Payments, then Manage automatic payments.
3. Select NCLEX Achiever and choose Cancel.

If you have trouble cancelling, email us at support@nclexachiever.com from the email address on your account and we will cancel it for you.

When you cancel:

• No further payments will be taken.
• Your Premium access ends as soon as PayPal confirms the cancellation to us, even if time remains in the billing period you have paid for. The unused time is not refunded.
• Your account moves back to the free Starter plan. Your account itself is not deleted.

Tip: to get full use of a period you have paid for, cancel shortly before your next renewal date rather than right after paying.

7. Refund Policy

All payments are final

Because Premium gives you immediate access to our full digital content, all subscription payments, including first payments and renewals, are non-refundable. We do not give refunds or credits for partial billing periods, unused time, unused features, a change of mind, or for Premium time lost when you cancel.

When we will refund you

We will refund a payment in full if:

• Duplicate charge: you were charged more than once for the same subscription and billing period.
• Charge after cancellation: you were charged for a new billing period after your cancellation had already been confirmed.
• Unauthorized charge: a payment was made from your PayPal account without your permission. Please also report this to PayPal.
• Premium never activated: you paid, but Premium was never activated on your account and we were unable to fix it.
• Required by law: a refund is required by consumer protection law that applies to you.

How to request a refund

Email support@nclexachiever.com from the email address on your NCLEX Achiever account, or use the Support page inside the app, and include:

• the email address on your NCLEX Achiever account;
• the PayPal transaction ID, the date and the amount of the charge; and
• a short explanation of the problem.

Please contact us as soon as you notice the problem. We will review your request and reply by email.

How refunds are paid

Approved refunds are issued through PayPal to the PayPal account or payment method used for the original payment, for the amount we received in US dollars. We cannot refund through any other method. The time it takes for the money to reach you depends on PayPal and your bank. If a refund covers your current billing period, Premium access for that period ends when the refund is issued.

8. Failed Payments and PayPal Disputes

• If PayPal cannot collect a renewal payment, or your subscription is suspended in PayPal, your Premium access is paused until the payment goes through and PayPal re-activates the subscription. If it is not resolved, the subscription may be cancelled.
• If you believe a charge is wrong, please contact us first. We can usually resolve billing problems quickly. Nothing in these Terms limits any rights you have under PayPal's Buyer Protection or User Agreement.

9. Acceptable Use

When using the Service, you agree not to:

• copy, download in bulk, scrape, record, screenshot for distribution, publish, sell or share our questions, rationales, lessons, case studies, flashcards or other content;
• share your account or subscription with anyone else;
• use bots, scripts or other automated tools to access the Service;
• try to bypass plan limits, payment checks or security measures, or access areas or data you are not authorized to access;
• reverse engineer, disrupt or overload the Service;
• upload or send anything unlawful, abusive, misleading or harmful, including through Nurzo, support tickets or question reports; or
• use the Service to build a competing product or dataset.

10. Our Content and Intellectual Property

The Service and its content, including questions, rationales, explanations, lessons, audio, video, images, case studies, flashcards, software and the NCLEX Achiever and Nurzo names and logos, are owned by NCLEX Achiever or its licensors and are protected by intellectual property laws.

While your account is in good standing, we give you a personal, limited, non-exclusive, non-transferable licence to use the Service for your own exam preparation. All other rights are reserved.

Notes, question reports and other material you submit remain yours, but you give us permission to store and use them to provide and improve the Service.

11. Nurzo (Our AI Coaching)

Nurzo uses artificial intelligence to suggest study priorities, build study plans and answer questions about study topics. AI-generated content can be incomplete or incorrect. Nurzo is a study aid only: it is not a nursing instructor, it does not give medical or clinical advice, and its answers must not be used to care for real patients. Always check important information against your course materials and official sources.

12. No Guarantee of Exam Results

Your exam result depends on many factors outside our control, including your own preparation and the exam itself. We do not guarantee that you will pass the NCLEX or any other exam, or achieve any particular score. Practice exam results, readiness indicators and study plans in the Service are estimates to guide your study; they do not predict your official result. Failing an exam is not a reason for a refund.

13. Disclaimers

The Service is for educational purposes only. It is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, including that the Service will be uninterrupted, error-free or that all content is complete, current or accurate. Nursing practice standards and exam content change; you are responsible for confirming information with official and up-to-date sources.

14. Limitation of Liability

To the fullest extent permitted by law, NCLEX Achiever will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, opportunity, licensure or income, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Suspension and Termination

• You may stop using the Service at any time. To delete your account, contact us at support@nclexachiever.com. Cancel your PayPal subscription first so that you are not charged again.
• We may suspend or close your account, without refund, if you seriously or repeatedly break these Terms, for example by sharing your account, copying our content or committing payment fraud.
• Sections of these Terms that by their nature should continue after your account ends (such as intellectual property, disclaimers, limitation of liability and governing law) will continue to apply.

16. Changes to the Service and These Terms

We regularly add, change and remove features and content. We may also update these Terms, for example when we add new payment methods. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or in the app. If you keep using the Service after the changes take effect, you accept the updated Terms. If you do not agree, you can cancel your subscription and stop using the Service.

17. Governing Law

These Terms are governed by the laws of the Arab Republic of Egypt. Any dispute relating to these Terms or the Service will be subject to the jurisdiction of the competent courts of the Arab Republic of Egypt. This does not take away any mandatory consumer protection rights you have under the law of the country where you live.
